3Specials DMCA Policy

1. Overview

3Specials LLC (“3Specials,” “we,” “our,” or “us”) respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). This policy describes how copyright owners may report alleged infringement of their copyrighted works on the 3Specials platform (the “Service”), and how affected users may respond.

2. Designated Agent

Our designated agent for receiving DMCA takedown notices is:

Our designated agent registration with the U.S. Copyright Office has been submitted (March 30, 2026) and is pending public directory listing. This policy is effective upon publication.

3. Filing a Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on the Service infringes your copyright, you may submit a written takedown notice to our designated agent. Your notice must include:

  1. Identification of the copyrighted work you claim has been infringed. If multiple works are at issue, provide a representative list.
  2. Identification of the material you claim is infringing and its location on the Service (such as a URL or description sufficient for us to locate it).
  3. Your name, mailing address, telephone number, and email address.
  4. A statement that you have a good‑faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
  6. Your physical or electronic signature.

4. How We Respond

Upon receiving a valid takedown notice, we will:

  • promptly remove or disable access to the allegedly infringing material;
  • make reasonable efforts to notify the user who posted the content that it has been removed; and
  • provide the affected user with information about how to submit a counter‑notice.

5. Counter‑Notice

If you believe your content was removed in error or that you have authorization to use the material, you may submit a written counter‑notice to our designated agent. Your counter‑notice must include:

  1. Identification of the material that was removed and its location on the Service before removal.
  2. Your name, mailing address, telephone number, and email address.
  3. A statement, under penalty of perjury, that you have a good‑faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which 3Specials may be found) and that you will accept service of process from the person who filed the original takedown notice or their agent.
  5. Your physical or electronic signature.

6. After a Counter‑Notice

Upon receiving a valid counter‑notice, we will:

  • forward a copy of the counter‑notice to the original complainant;
  • inform the original complainant that the removed material may be restored in 10 business days unless the complainant notifies us that they have filed a court action seeking a restraining order against the user; and
  • restore the material no earlier than 10 business days and no later than 14 business days after receipt of the counter‑notice, unless we receive notice of a filed court action.

7. Repeat Infringers

3Specials may, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers. We determine repeat‑infringer status based on the number of valid takedown notices received, the nature of the infringement, and whether the user has submitted meritless counter‑notices.

8. Misrepresentation

Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys’ fees.
